Guards' Recall Bid Rebuffed

Group Has 10 Days To Revise Petition

The California Secretary of State's Office said it has rejected a petition by the California Correctional Peace Officers Association to recall Gov. Arnold Schwarzenegger.

The union's failure to include Schwarzenegger's response to their recall effort on the petition violates California law, the office said.

"The prison guard union leadership's irresponsible attempt to manipulate the system was rejected once again today -- this time by the Secretary of State's Office," Adam Mendelsohn, senior political advisor to Gov. Schwarzenegger, said in a statement. "The union leadership's refusal to comply with the most basic requirements of the law proves yet again that their recall attempt is all about politics and has nothing to do with policy. This is simply about one union using tactics of political intimidation to get a pay raise."

The prison guard union has 10 days to revise the petition and re-submit it, the office said.

It is not uncommon for first drafts of recall petitions to require revisions to comply with state law, office spokeswoman Kate Folmar said.

A union spokesperson said earlier this year that they are upset with the governor for not exempting more than 30,000 prison guards from the executive order to reduce salaries to $6.55 an hour.

Aaron McLear, a spokesman for the governor, said the union is just upset that their proposed raise was not passed, and that Schwarzenegger will not be intimidated by the threat of a recall.

Schwarzenegger's campaign to become governor was successful after a recall effort against Gray Davis in 2003.
